Not only is the Oklahoma constitution being disregarded so is nearly the ENTIRE U.S. Constitution.  Just one example of this is the passing of the Military Commissions Act (//%22http://www.msnbc.msn.com/id/15220450/%22) which officially ends the Writ of Habeus Corpus.  Our Oklahoma Constitution specifically says The privilege of the Writ of Habeas Corpus shall never be suspended by the authorities of this State. (//%22http://oklegal.onenet.net/okcon/II-10.html%22) -Section II-10: Habeas corpus - Suspension.  What are we going to do about this?

Wow, an architect, an engineer, an expert on US banking policies, AND a legal scholar.  I'm impressed.  What we have here folks is yet another logical falicy.  

3 step process, are you ready?

1) US Constitution is greater than and trumps the  Oklahoma Constitution
2) The US Constitution SPECIFICALLY allows the Writ to be suspended, and it has been suspended (Washington, Lincoln, & Roosevelt to name a few of the lowlife's guilty of such an act).
3) Therefore, the Oklahoma constitution must allow the Writ to be suspended at the federal level.

You will first be directed to the general principle of federalism contained in the preamble of the constitution. This second and standing at the creation of our United States sets up the hierarchy of our laws.  What is commonly known as the "supremacy clause" of Article VI clearly states that Federal law "shall be the supreme Law of the Land" and the US Constitution shall govern above all.

Next, I will point out that you blatantly mis-stated the law on habeas corpus.  The word NEVER does not appear in the US constitution (nevertheless & whenever are your closest references), it certainly does not appear in reference to habeas corpus which specifically allows the writ to be suspended. Thus, any language in Oklahoma using such robust language is necessarily trumped.

Article II, ยง 9 of the US Constitution states:

The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.


The Oklahoma constitution forbids the STATE from acting. So when the state of Oklahoma suspends the Writ you have a claim against the STATE. Unfortunately, the Writ is suspended at the Federal Executive level... so your claim is highly unlikely to ever ripen.

Therefor, it does not matter what the Oklahoma Constitution says, the Writ can be suspended for the reasons stated.  While I disagree with the current state of affairs, nearly everything is done int he name of "public safety" from the Brady Bill, to not being able to get decongestants at Walgreens, to a $100 tax on most plane tickets for the farce of public safety.  We sold our freedom a long time ago for public correctness and the illusion of safety.

I actually saw an art exhibit one time that trampled on the flag to comment on the constitution.  Im not sure how its relevant, but for some reason I am reminded of the installation:

Set in the corner was a podium with a sign that said "comment welcomes" and a book with a pen for said comments. Behind the podium was a screen that had horrible things projected on it the changed (God hates fags.  Nig***s back to Africa. To our soldiers in Bosnia:  How many women did you cluster bomb today?  Native America traded their land for Whiskey - its not my fault their so stupid). In front of the podium laying on the floor was a huge American flag. Thus, the only way to comment in the book was to walk on the American Flag.

When you walked on the American Flag (which many people did with great hesitation) and got to the book the cover read:

"Congress Shall Make no Law... abridging the freedom of speech." Even though you trampled on the American Flag, you are still free to write whatever you want in my book.

Thought was was interesting.

Several of the news outlets were taking Rosie O'Donnel to task last night, wondering when she's going to get the axe from "The View".

I'm just curious where Alt has been to say that since Rosie is on the WTC 7 brigade that it definitely happened. [:o)]

As many are aware the Oklahoma constitution is not to be applied to the State of Tulsa.  

Oklahoma is comprised of many nations of the American Indian set aside by treaty with Tulsa as a political entity that refuses to be absorbed in the facts of reality.    

We do not trample the Oklahoma constitution we just ignore it.
