For those who were following the story and are interested I finally spoke with the D.A.'s office. The individual will now be charged with a criminal felony. The attorney I spoke with did not understand why the arresting officer initially did not charged him as such. Also, I just checked OSCN today and he was arrested on the 12th. Hopefully he will not see the free world for a while.

Good for you. I am at home all day with 3 small kids and cannot imagine how horrible that must have been for your wife.
Thanks for the update. When I read your initial story, I couldn't understand why they weren't doing something. It met every definition of "breaking and entering" I've heard.

I have been following this to see how things turned out. I'm glad that his time will come for this crime, and thankful that no one was hurt. Too often home intrusion/invasion situations turn out worse. Too many here have been beaten badly or died at the hands of the perps.

Yes, here in Phoenix during quite a few of the home invasion, the owners are often tied and beaten. There was one instance about 10 years ago where an elderly couple, husband 80ish wife in 70's, theives broke into the house and beat one of them so badly they later died of the injuries. The worst one, and it was a retribution invasion, happend about a month ago when people dressed in Phoenix police SWAT clothes invaded a house belonging to an illegal that was dealing in large quantities of drugs, got into the home and in the span of 10 minutes fired between 150 and 200 rounds from automatic rifles, and then left. Two of the invaders were later arrested when they where laying in wait to ambush the cops in an alley there weapons jammed. During interviews both suspects caught claimed to be part of the Mexican Military and if their guns had not jammed they were willing to kill the police as well.
