In the prop 8 case he asked the pro-equalitu side to prove to him that allowing gay marriage won't hurt the children.  When it was pointed out that California already allows adoption by gay couples that was jot sufficient.  When it was pointed out that no peer reviewed study in over a decade comes to such a conclusion he commented that I this a new issue and we really don't know.

What is truly scary is that such an argument was made against inter racial marriages 45 years ago.  The "we don't know, it might hurt the children so deny civil rights" argument was illogical then, and it is now.  You can not EVER prove than any ruling will not have some effect or other. Basic logic - you can't prove a negative.
