Well I think that I'm basicly screwed on this one but I am going to ask you guy's anyway.
I was at the Hard Rock Saturday afternoon to see the Pawn Stars(I love that show)
I was there for about three hours waiting for their autograph session.
A little after 3 the little lady and I were almost to the stage area and as we were walking forward somehow I tripped and fell over their hook rope that was seperating the wall from the people standing in line.
I got up immediately and got back in line with a very sharp pain in my right shoulder.
We went on stage got all the signatures and left the Casino.
Went straight home and the pain became to much to bare so we went to the new St Johns Hospital out here in B.A.
I dislocated my right shoulder and I am still in quite some pain.
I contacted the Casino yesterday and Security wants me to come up there tonight and fill out a report.
I am truly not the type who tries to sue over something as my clutsyness.
Has anyone here ever had any dealings with the Casinos and their on property accidents ?
I mean if they even would help me out a little with the Hospital bill I would take that as a win.

Dont do that.
It would not be to your advantage, and you are under no obligation to do so.

I've known several places to do that and pay out pretty good money without a lawyer ever being called.

I dunno but it'll be worth a shot. I fell off a ladder last Monday hurt my right side, but it was a few days latter that it started to hurt more, I just left it and now the pain is just about gone. I have not a clue what I injured. I hate the hassle and long waits to go to a ER plus the unending medical bills that come in the mail afters. Anyhow my right side is much better now. But Yes as long as you went for medical treatment I'd give it a shot.

I was on a jury for a trip and fall at a hotel conference.  Apparently they offered her a nice settlement after she filled out the accident report but she waived it after talking to a lawyer.  She lost in court.  Fill out the form and take any settlement.

I know how you feel about going to the E.R. I was totally against it. Thats why we didnt get there till after 8 oclock. But once they took X-rays and had to put me under twice to get it back in place. I was glad I finally gave in and went.
Like I said. If they want to help out in even a little way. I would feel much better about the situation.
Also, and I'm not about to tell them. I cant stand Casinos and I never go to them, Ever.

Once you find out how easy it is to get money, I strongly suggest you make a habit of it.   Reasors looks like a potential cash cow.

Also, think about suing your shoe manufacturer.    Maybe your sock manufacturer as well as it might have been bunched up and not properly elasticized keeping it high up on your ankles.

Oh.   And you better go back and delete your first post as you all but admitted it was your fault.

I went and filled out my report to the security last night and the gentleman was very courteous and nice about my situation. He is going to give the report to his supervisor and it will be reviewed and they will contact me.
So I will post what happens in the coming days. Thanks for all the responses.

Nice. I have not talked to a Attorney nor do I have any intention of doing so. I basicly wanted to know if a big business such as a Casino has a policy about someone having a "Accident" on their property. Doesnt matter how it happens, i.e. slipping on a oil patch at the pumps at Q.T.
Not everyone is a vulture of the law. I know coffee is supposed to be hot.

as a small business owner who has been through this, this pisses me off...
you tripped and you described it "as my clutsyness", smile happens...

fwiw, you'll get the insurance's usual payout offer to go away (in my case they offered the guy 5k) and you'lll bump the casino's rates but then again, what do you care? this makes me sick.

and i wouldnt make a habit of discussing this in an open forum or via any discoverable electronic media. just sayin'

I have not mentioned one dime to them or said anything about suing anyone. YOUR PISSING ME OFF !
I asked a simple question if anyone had delt with a Casino or knew of anyone who had, that had a "Accident" Do they have a standing POLICY for this type of incident ?
If they offer to pay anything of my Medical bill, Fantastic. If not, I walk away.
Sorry that either of you got caught up with someone who uses the Law as their income.
I have a job and it's not making frivolous Lawsuits.

Because your accident happened on Cherokee property, your claim is governed by Cherokee law.  The Cherokee gaming ordinance/statutes set out an administrative claims process.  You started the process by completing a form.  Typically, it will be investigated and a ruling made.  However, there are deadlines for action (you can probably find the ordinance on their website).  They should have given you an informaiton sheet describing the process and your rights.  Typically, if the Tribe does not render a decision within the prescribed amount of time (I don't recall how long it is for the Cherokee), you may initiate an action in the Cherokee courts.  Be careful though, the deadlines can be very short and if you miss it, you are out of luck.

Tort claims by non-Indians that occur in Indian casinos have been hotly litigated for the past few years in Okla.  Some attorneys may tell you to sue in Okla. state court.  If you do, however, be prepared for a much longer and more difficult fight because of the sovereignty issues.

I'm willing to bet that since your injury was a result of your own "clumsieness" that they don't have to pay anything, but in order to prevent a lawsuit (not saying you're going to file one) they will possibly offer to pay a portion if not all of the bill as a goodwill gesture. Most public place have, and I will use sporting events as a reference, a written policy that the print on the ticket, and post signs stating they are not responsible for injuries. Get hit with a ball, puck, stick, bat, player they are not liable. Fall and hurt yourself because of a damaged step on the stairs, they are. Trip over your own feet in a casino, they're not, the seat you are sitting playing a game breaks, they are. Willing to bet they make some sort of goodwill offer. If not, life goes on.

You're not going to sue. Good for you. That seems appropriate and is the right couse of action.

Granted, I did "+1" TeeDubs comment but I didn't state that you were going to sue. I asked why you expect anyone other than you to pay for your medical bills due to something you attribute to your "clutsyness"...

Lawsuit or not these situations become a nightmare for the small businessman. You can see why a business would get antsy when you ask them to help pay for your injuries and why they would presume that if they don't that you'll sue. Lawsuit or not, these situations will involve the business having to contact/pay their attorney. Would you be asking about payment for your bills if your "clutsyness" had caused you to fall at "The (fill-in-your-favorite-restaurant)"... or is it just 'cause its the casino.

Will you still be so adamant that you won't sue, when the casino says "No, Thanks." and then William Shatner, ESQ sends you an unsolicited letter about your recent injury and your potential claim? Because, I know for a fact that his office trolls here. Additionally, they monitor ems radio services for calls and have insiders with EMSA, several local urgent cares/EDs that feed them cases. Genuine-real-live ambulance chasers. True story.

I'm glad you are not suing. I'm sorry that I indirectly implied that you were.

I like asking my questions here because I have a lot of respect for you guy's and I want honest opinions from people I presume are more knowledgable than I.

Breadburner I am not sure what Columbus day has to do with it, But I can say that it happened the day the World was supposed to end.

I dont know. Is the City of Tulsa a business ? And is the park a public facility. Hmm nice example.

for the record, I can't stand stupid lawsuits, but I say when it comes to the casino's, sue them for whatever you can.  I can't stand these places (and it really has little to do with the so called evils of gambling) and would love to see them suffer.  That is just me though, and only about these entities.

Chandler is a county park, COT has no jurisdiction.

It's arguably negligent to place a rope in such a way that a person could easily trip over it.

Ironically, the whole problem could be solved with single payer health care. Many personal injury lawsuits are more about finding a way to pay the exorbitant medical bills than anything else.

Actually, the process is similar to that in the casino.  Under tort claims acts you could file a claim and get a determination from the governmental body.  If denied, you could then file a lawsuit.

Premises liability claims, or so-called "slip and fall claims", are often subject to abuse because the injury suffered is typically small with no permanent disability, and, therefore, the defendant often pays a nuisance value to make it go away, i.e. it will cost more to defend against it than to simply make a nominal settlement.  Of course, this just encourages more specious claims to be filed.  Not all claims are bogus and the threat of liability should encourage businesses, municipalities, etc. to maintain their premises in a safe condition for their guests and invitees.

I disagree - in my experience it is more often about greed than need, and the fact there is no disincentive to plaintiffs for filing weak cases (their lawyer is typically taking on the risk of loss through a contingency fee arrangment).

Sure, it is about greed sometimes. But when a significant fraction of our fellow citizens don't have the means to come up with even $2,000 on short notice and many to most of those lack health insurance, it doesn't surprise me in the least that people feel the need to sue for relatively minor injuries.

And what lawyer in her right mind is going to take a shitty case on contingency, when they could be spending their time on cases that will actually make them money and doesn't carry the risk of being sanctioned for filing a frivolous lawsuit? There are a few, but again, it's a small minority.

Sanctions are rare for filing frivolous case and there are plenty of lawyers who work on a volume model (i.e. The Heavy Hitter).
