OKLAHOMA CITY (AP) -- One of Lt. Gov. Mary Fallin's Highway Patrol bodyguards has resigned after being accused of having an affair with her.

The accusation was made by her husband's lawyer during divorce proceedings last week.

Trooper Greg Allen denied having an affair with Mrs. Fallin and plans to seek reinstatement, his lawyer, Gary James, told The Daily Oklahoman for a story in Wednesday's editions.

James said Allen, who is married and has two children, admits holding Mrs. Fallin while she cried on his shoulder and admits kissing her in a platonic way, but insists there was nothing improper about their relationship.

"They became very good friends. Greg was Mary's confidante," James said. "I guess as a security guard you're not supposed to be a friend."

Allen first was asked about rumors of the affair Nov. 30 and then unexpectedly called into a meeting last week with two patrol officials, who asked him to resign Dec. 1, James said.

A resignation letter was already prepared and Allen was told he needed to make a decision before he left the meeting, James said. He complied, but sent the patrol a letter Friday asking that he be reinstated, James told the newspaper.

Mrs. Fallin, a Republican who was elected to a second term in November and has been touted as a possible GOP gubernatorial candidate, has filed for divorce from her husband, dentist Joe Fallin. At a hearing last week, her relationship with the trooper was described as "an affair" by Fallin's attorney.

Rumors surfaced in early September about her and a member of her security detail, Public Safety Commissioner Bob Ricks said.

The trooper first denied the allegations, but after questioning again in November, he "admitted to unprofessional conduct and was permitted to resign," Ricks said in a statement Monday. "His admission did not indicate that sexual activity was involved."

Ricks didn't elaborate on the nature of the unprofessional conduct, and his office said he was out of town Tuesday.

JUNEAU, Alaska - Five Republican state lawmakers filed suit Tuesday to end the bipartisan investigation into Alaska Gov. Sarah Palin's firing of the public safety commissioner even though the vice presidential candidate once said she welcomed the probe into allegations of abuse of power.

The lawsuit called the investigation "unlawful, biased, partial and partisan." None of the lawmakers who filed the suit in Anchorage Superior Court serves on the bipartisan Legislative Council that unanimously approved the investigation.

The scandal known as "Troopergate" gained national attention after Republican presidential candidate John McCain chose Palin as his running mate. Since then, Palin and the McCain campaign have sought to distance Palin from the controversy and have taken actions that could slow its resolution until after the November election.

Palin fired public safety commissioner Walt Monegan in July. Weeks later, it emerged that Palin, her husband, Todd, and several high-level staffers had contacted Monegan about state trooper Mike Wooten, who had gone through a nasty divorce from Palin's sister before Palin became governor. While Monegan says no one from the administration ever told him directly to fire Wooten, he says their repeated contacts made it clear they wanted Wooten gone.

Palin maintains that she fired Monegan over budget disagreements, not because he wouldn't dismiss her ex-brother-in-law. Still, she said in July that she'd welcome and cooperate with the investigation ordered by the Legislative Council. McCain campaign spokesman Ed O'Callaghan now calls the investigation "tainted."

On Tuesday, three state representatives and two state senators sued Democratic Sen. Hollis French, who is overseeing the investigation; Juneau Democratic Sen. Kim Elton, who heads the Legislative Council; independent investigator Steve Branchflower; and the Legislative Council itself.

The lawsuit seeks to either delay the investigation until after the Nov. 4 general election or remove French and Elton.

"There is no nonpartisan reason to complete this investigation until after the election," said Anchorage attorney Kevin G. Clarkson. "We just want to take the politics out of it and bring fairness back into it."

Clarkson said he and a nonprofit legal firm in Texas, Liberty Legal Institute, were donating their work on the suit. A phone message for French was not immediately returned.

The Legislative Council, made up of four Democrats and eight Republican, voted unanimously to investigate the circumstances of Monegan's dismissal. Although Monegan was an at-will employee who could be fired for almost any reason, lawmakers wanted to see whether Palin tried to use her office to settle a personal score with Wooten.

Last week the state Senate Judiciary Committee voted to issue subpoenas for Todd Palin as well as nearly a dozen others and to gain phone records of a top aide to the governor. The subpoenas seek to compel their cooperation in the investigation.

O'Callaghan said Monday that Sarah Palin, who was not subpoenaed, was unlikely to speak to Branchflower and that he didn't know if Todd Palin would challenge his subpoena. At the same time, the campaign released e-mails it claimed supported Sarah Palin's assertion that disagreements over budget were behind Monegan's firing.

Among the e-mails released was a farewell note by Monegan. In it, he suggested the governor had reason to believe she had lost his support, and he urged his former colleagues to communicate better with her.

"For anyone to lead effectively they must have the support of their team, and I had waited too long outside her door for her to believe that I supported her," he wrote. "Please, choose a different path."

Palin's lawyer has sought to have the three-member state Personnel Board take over to investigation, alleging that public statements made by French indicated the probe was politically motivated. French had said the results of the investigation could constitute an "October surprise" for the McCain campaign, and he later apologized.

The campaign insists that French, Branchflower and Monegan are friends, even though the men say they only know each other professionally and have never socialized. Democrats charged that the McCain campaign was trying to stall the investigation.

"Rather than cooperating with the investigation, the Republican presidential campaign is doing everything it can to stall and smear," said Patti Higgins, chairwoman of the Alaska Democratic Party.

McCain campaign spokeswoman Meg Stapleton denigrated Monegan at a news conference Monday, accusing the veteran law enforcement officer of "insubordination," "obstructionist conduct" and a "brazen refusal" to follow proper channels for requesting money.

When Monegan was fired, the governor offered to let him head the state Alcoholic Beverage Control Board. Asked why someone with a history of insubordination would be given such a position, Stapleton said that without having to deal with a budget, Monegan would be able to focus on alcohol abuse issues.

The governor "respects the fact that he was respected in the community," she said.

Thomas Van Flein, a lawyer for the governor's office, cited the newly released e-mails Monday in asking the Personnel Board to find no probable cause for an ethics investigation.


In an interview Monday night, Monegan said Palin never raised concerns about his management. In fact, at an event in May, she singled him out and praised his efforts to reduce violence against native women.

"In my time as a commissioner, the governor has never talked to me about complaints about my efforts," Monegan said.

I don't think this was a well-timed move.  At all.





Typical case of Prematureaccusation.  They should have waited until a week or two before the election, then their chances of sensationalizing a steaming load would be greater.

I haven't been seeing a whole lot of wise strategy here.  From the ads in poor taste, to Obama and Biden's personal gaffs to attempting an October surprise in September.

The great lesson of the Bush era: cover-ups work
It's a truism repeated in the media at least a hundred times a day: the cover-up is always worse than the crime.

Bull.

If the last seven years prove anything, it's that covering up wrongdoing actually often works like a charm. But the trick is that it has to be carried out audaciously and without mercy. Bush-style cover-ups are definitely not for the faint-hearted. There's no room for ethics, or even shame. You have to be willing to make any argument, no matter how silly: cast any accusation, no matter how groundless.

Never look back; never give in. Attack the victim. Attack the witnesses. Attack the process. Claim that you're the victim of a politically motivated witch-hunt no matter how fair the investigation may be. Charge the investigators with bias.  

Stall, stall and then stall some more. Run out the clock.  

In Bush-style cover-ups, there's no such thing as a discoverable document: everything — every last piece of paper and the paper clips that bind them — must be withheld under claim of executive privilege. No governmental employee must ever be allowed to give testimony in court or before the legislative branch. The only place they can be allowed to speak — even if what they're speaking is a fairy tale (especially if it's a fairy tale) — is on Fox News.

Just say no. Scoff at subpoenas. Grind the rule of law into the ground like a steamroller crushing a dirt clod. Dismiss the legitimacy of oversight. Play the press for suckers.

Cover-ups don't work, you say? Come on — wake up and smell the corruption. Successful use of cover-ups is the only thing that's kept Bush and Cheney in office.

And it would seem that what's good for Bush is also good for Sarah Palin. You remember Troopergate — the investigation Palin promised to give her full cooperation. But that was then. Today, under the tutelage of Bush and McCain Republicans, she now refuses to testify — refusing even to meet informally with the investigators. Not satisfied with that, she's also seen to it — through the intervention of the attorney general she appointed — that no other state employee will cooperate.  

Meanwhile, GOP lawyers have descended upon Alaska by the scores to help with the cover-up. That's the thing about Republicans and lawyers: they hate them except when they need them, which lately has been most of the time.

McCain said during his acceptance speech that he couldn't wait to introduce Sarah Palin to Washington. I don't know about that, but clearly he wasted no time in introducing the ways of Washington to Sarah Palin.

And it appears that the Palin cover-up may be working out just fine and dandy: word is that the Alaska legislature, bending to GOP pressure, may put off its official investigation into Troopergate until after the election (if ever).

McCain/Palin may well end up paying a high price politically for the bad publicity their stonewalling on Troopergate has produced. But please, spare me the lectures about how cover-ups always end up worse for the perpetrators than the original crime: because it just isn't true.

It's really time for us to take back our country and hold these people responsible for their actions - NO more refusing subpoenas. If you or any other devil tried to refuse, we would find ourselves in jail quicker than you can say "what me?" - the rule of law has been raped by this administration, including Palin now that she is refusing to cooperate. FOTD is sick and appalled at our country and the path we are currently on.

The Legislative sponsored investigation strayed sharply from a Pursuit for the Truth into a Pursuit of the Governor's Head.

Alaska has a strong Governor form of government.  

LEGALLY, the Governor has the RIGHT to fire the Public Safety Commissioner for ANY reason.

She didn't need a reason, although she may have had some personal feelings about the Trooper's boss not adequately disciplining the Trooper's psycho behavior.

She cannot fire him in retaliation for exercising his Constitutional rights.  She cannot fire him for his political affiliation.  She cannot fire him because of race, gender, religious ideology, etc.

But she did fire him.  And she "welcomed" the investigation, claiming she had nothing to hide.

Now she is refusing to cooperate with that same investigation.  I think its fair to question her rationale here.      





Oh, I would say Gov. Palin hearing from the Troopers lips that he was going to kill two senior citizens just might, possibly be grounds for discipline.

The Governor overheard the trooper threaten to KILL both of her parents.

Case:  CLOSED.





Then why doesn't she testify to it?

Something to hide maybe?



You are wise to question his brazen remarks.

She is not in control of her own life at this point whether she wants to testify or not. The Ma&Pa Kettle ticket has too much at stake to be messing with this tempest in a teapot. It will fade soone enough as well as any chance of finding out what really happened.

The Troopergate scandal is taking on some odd twists. It seems that the McCain campaign, as a result of the scandal, is actually running the state of Alaska now, unelected and unappointed. Further, these McCain staffers running Alaska are making the kind of whiney excuses and incompetent decisions worthy of McBush.

There's more in the LA Times today. Even Republicans in Alaska are complaining that the unelected McCain campaign has taken over governance in the state.
