Title: SMFH
Post by: Hoss on January 03, 2015, 05:19:04 pm
Yet another reason other people in the nation (and maybe even world) can point and make fun of Oklahoma.

Good. Maybe this will lead ^^^ to finally leave the state he is sick of. The upside of that will be room for the large influx of new people relocating here.

As for hoodies, good luck wearing one on your head in the court house. I was told to take mine off.  Below is the text of the proposed statute from the OP link:

Quote
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. AMENDATORY 21 O.S. 2011, Section 1301, is
amended to read as follows:
Section 1301. It shall be unlawful for any person in this state
to :
A. To wear a mask, hood or covering, which conceals the
identity of the wearer during the commission of a crime or for the
purpose of coercion, intimidation or harassment
; or
B. To intentionally conceal his or her identity in a public
place by means of a robe, mask, or other disguise.
provided Provided, the provisions of Section 1301 et seq. of
this title shall not apply to the pranks of children on Halloween,
to those going to, or from, or participating in masquerade parties,
to those participating in any public parade or exhibition of an
educational, religious or historical character, to those wearing
coverings required by their religious beliefs, for safety or medical
purposes, or incidental to protection from the weather, to those
participating in any meeting of any organization within any building
or enclosure wholly within and under the control of said
organization, and to those participating in the parades or
exhibitions of minstrel troupes, circuses, sporting groups, mascots
or other amusements or dramatic shows. Any person, or persons,
violating the provisions of this section, shall be deemed guilty of
a misdemeanor, and upon conviction thereof, shall be punished by a
fine of not less than Fifty Dollars ($50.00) nor more than Five
Hundred Dollars ($500.00), or by imprisonment in the county jail for
a period of not exceeding one (1) year, or by both such fine and
imprisonment.
SECTION 2. It being immediately necessary for the preservation
of the public peace, health and safety, an emergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.

Emphasized portion will be difficult to enforce I suspect.

As "requested legislation"" from the DPS; it amends existing law that already makes it illegal to "wear a mask, hood or covering, which conceals the
identity of the wearer during the commission of a crime"

by adding  "or for the purpose of coercion, intimidation or harassment; or to intentionally conceal his or her identity in a public
place by means of a robe, mask, or other disguise"

...which blurs the distinction between "commission of a crime" and perceived intentions of a crime.

So I guess that if I come back, I should leave the "hoodies" that I wear should be left behind. Doesn't matter that I can wear them anywhere else, but in Oklahoma, I can't have one. Yeah, I want to visit. Is there anything else I can't wear while I'm in Tulsa and OK? Should I make sure that I don't have anything red or blue that might be taken as Crip's or Bloods? Guess I should make sure that I don't go through Colorado, don't want any cross contamination of luggage to cause me to be considered a smuggler. Pretty sad when the state I was born in, that I want nothing to do with.

Too bad Guido, I ain't leaving.  I'm a native Oklahoman.  Which gives me even MORE right, IMO, to grumble about this stupid assed law.

Continue chasing your ambulances.   ;D

Oklahoma Senator Draws Fire after 'Hoodie Ban' Outrage

Quote
OKLAHOMA CITY (AP) — A state senator who says he was trying to protect law enforcement has instead come under fire from people who think he's trying to ban hoodies in Oklahoma.

Republican Sen. Don Barrington of Lawton says his office has been flooded with calls and emails since stories began circulating on social media about a bill he introduced ahead of the upcoming legislative session.

Barrington's bill doesn't mention hoodies, but would make it illegal for someone to conceal his or her identity in public by using a "robe, mask, or other disguise." The language would amend a section of law originally targeting the Ku Klux Klan.

He says he was prompted in part by mask-wearing protesters who rallied at the Capitol in recent years and caused problems for security.

I just don't see what the wadded up panties are all about over this. But Alex Jones seems to think so, because we have to have the "oh-so-original" Guy Fawkes mask wearing @-holes, or people wearing bandanas over their face as if they are robbing a train, at protests.

LOVE this post from the comments to the above article: "Thou shalt not hinder the surveillance state." Immediately thought of patric and Vashta....

Fine. Here's what legal professionals are saying:

This bill is an affront to fundamental rights, including the rights of of free speech and privacy. No one should worry about retaliation or retribution because they choose to attend a rally or a protest, which is precisely why the First Amendment protects anonymous speech in these instances. It is no less concerning that such a vague and overly-broad law would invite selective enforcement and over-policing of otherwise law-abiding people.

For lawmakers who campaign against Government overreach, voting against this bill would be a great way to practice what they preach.

Ryan Kiesel, ACLU

Here in Oklahoma, it has been illegal to use a hood, mask, or disguise for criminal conduct for over 90 years. This bill does nothing whatsoever to strengthen that law or to prevent or punish crime. Instead, this bill specifically targets only law-abiding individuals. Worse yet, the bill explicitly attempts to criminalize protected First Amendment rights. This bill would turn Oklahoma law enforcement into literally “the fashion police.” What it proposes is both unnecessary and unconstitutional. Instead of bringing criminals to justice, this bill is far more likely to land the State of Oklahoma in the courtroom.
Brady Henderson, ACLU
