The Whirled recently cited an Associated Press report on the Enron trial, where Ken Lay's lawyer opened his client's defense with the statement:  

"Bankruptcy is not a crime.  If it were, we would have to turn Oklahoma back into a penal colony because there would be so many to lock up."

Nice to know the energy industry's big guns have their feet planted squarely on the ground.
